These terms and conditions refer to the company LIBURNIA RIVIERA HOTELS JOINT STOCK COMPANY, hereinafter referred to as “LRH”, as the organizer of the Imperial Spirits Festival in Opatija, Croatia. Conflicting terms and conditions are hereby contradicted. Verbal agreements and assurances require written confirmation. All personal pronouns used in these terms and conditions, whether used in the masculine, feminine or neuter gender, shall include all other genders, and the singular shall include the plural and vice versa. Any guest at an event of Imperial Spirits Festival in Opatija considered a visitor. 

By accessing this website, you are agreeing to be bound by these website GENERAL Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and TRADEMARK law.

USE LICENSE

Permission is granted to temporarily view or download one copy of the materials (information or software) on LRH’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials.
• use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
• attempt to decompile or reverse engineer any software contained on LRH’s website.
• remove any copyright or other proprietary notations from the materials; or
• transfer the materials to another person or “mirror” the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by LRH at any time. LRH makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, LRH does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet website or otherwise relating to such materials or on any sites linked to this site.

LIMITATIONS

In no event shall LRH or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on LRH’s website, even if LRH authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

REVISIONS AND ERRATA

The materials appearing on LRH’s website could include technical, typographical, or photographic errors. LRH does not warrant that any of the materials on its website are accurate, complete, or current. LRH may make changes to the materials contained on its website at any time without notice. LRH does not, however, make any commitment to update the materials.

LINKS

LRH has not reviewed all of the sites linked to its Internet website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by LRH of the site. Use of any such linked website is at the user’s own risk.

CANCELLATION / PROGRAM CHANGES

LRH reserves the right to change the program or dates at short notice and does not authorize the return of the ticket. In case of cancellation of the festival an unusability of parts of the premises or a temporary failure of the technical equipment due to force majeure, there is no claim for price reduction. Any expenses incurred (arrival, departure, accommodation, processing fee, etc.) will not be reimbursed by the LRH in the event of cancellation, postponement, program or cast changes if not fault of the LRH.

SITE TERMS OF USE MODIFICATIONS

LRH may revise these terms of use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these general Terms and Conditions.

Any claim relating to LRH’s website shall be governed by the laws of the Republic of Croatia without regard to its conflict of law provisions.

VISITORS

LIABILITY

After the end of the event, LRH accepts no liability for visitors, who are still on the festival grounds respectively re-enter after closing. The offered visitor facilities need to be treated with due care. All other facilities may not be entered or launched. Visitors need to leave the festival and its grounds at closing time.

ID

Each visitor is committed to bringing a valid, officially approved ID. Copies or other IDs are not accepted.

ANIMALS

It is not permitted to bring any animals to the festival grounds. Excluded guide dogs, provided they carry a bite basket and are kept on a leash.

SAFETY INSTRUCTIONS

The instructions of the LRH, crew, security and supervisors must be obeyed.

VIOLENCE

All kinds of violence are strictly prohibited. Contravention results in immediate expulsion from the venue and possibly a complaint at the responsible authority.

SOUND AND VISION RIGHTS

The visitor agrees that recordings and pictures of him will be recorded analogue and digital and the recordings or parts of the recordings will be published without compensation and without visitor consent. The recordings can be used for the re-reporting of the respective festival, but also for the application of the next festival of this kind or events of a similar kind. You can contradict the publication of the image data in writing via dpo@liburnia.hr at any time. All entrances of the festival are video monitored. Own sound-, film- and photo- recordings are not permitted (except for private use). For an exception, a written declaration of the LRH is necessary. If images, photographs, or video recordings are transmitted to LRH or published on the Internet, LRH is granted the right to publish them and pass them on to third parties for the purpose of publication. The author expressly waives the right to name the author.

Any recording, be it photo, video, or audio, must be at least visibly/audibly marked as recordings of the Imperial Spirits Festival.

Regarding videos, especially those uploaded to the platform YouTube, Facebook, Tik Tok, Instagram, Google analytics etc., it is prohibited to use in the video title phrases such as “official” or “official aftermovie” or phrases that suggest that it is an official Imperial Spirits Festival video.

VOLUME/HEARING PROTECTION

The sound level at this event exceeds 93 dB and can put your hearing at risk. The wearing of hearing protection, especially near the stage areas, is strongly recommended.

BROUGHT OBJECTS

Illegal items (weapons, drugs, etc.) are handed over to the police. The LRH is not liable for the safekeeping of such items. Each visitor agrees to a search of his bags and private items for such items. If a visitor does not allow this search, he has no right to enter the venue. The LRH reserves the right to banish persons, who try to smuggle forbidden objects on the event area.

The LRH is not liable for handed articles at other spots (deposit at bars or stages, hiding at the venue, etc.) as in this case no contract of safe custody is concluded.

BAG SEARCH

The LRH reserves the right to search visitors before entering the festival and on the festival premises for dangerous or prohibited objects. If such an item is found, it will be removed without exception.

ALCOHOL AND DRUG INFLUENCE

Heavily intoxicated individuals by alcohol or other drugs are not eligible to enter the festival grounds. No right for a refund of the ticket price in this case.

MINIMUM AGE

The minimum age for entering the festival is 18 years. Taking along an elderly companion or a letter of permission from the parents does not change the rules.

PARKING AREA

The entrance to the parking area is only allowed with a valid ticket during the opening hours. Sleeping in the parking area is prohibited both inside and outside a vehicle. Camping and the building of tents is prohibited on the parking area. The assigned parking area is to comply. It is forbidden to park at the streets between the parking spaces. LRH is not liable to purple hurt or damage on cars or other things caused by a third party or force majeure. Also LRH is not liable to stuck vehicles.

There is no custody agreement, the parking area is not guarded. It is a lease for temporarily parked vehicles.

It is forbidden to park on the traffic lanes between the park rows. Uneven ground, bumps and other obstacles may occur in the parking lots, temporary traffic areas, as well as on entry and exit streets. Drive accordingly slow and with increased awareness.

Waste dumping at the parking lot is strictly prohibited. The LRH is not liable for personal injury or property damage caused by third parties or force majeure. Furthermore, the LRH is not liable for any stuck vehicles. There is no custody contract, the parking is not guarded – it is a lease for the temporary parking of a car. For carried and on the parking lot located objects, the LRH assumes no liability. The entrance and exits of the parking lots are checked during opening hours, there are regular tours of the parking areas.

GARBAGE

Any kind of garbage is to be deposited in the designated containers and not to be thrown on the ground or otherwise left behind.

TICKET PAYMENT

Tickets for the festival can only be purchased on the website /www.liburnia.hr/ and by the Eventim system for ticket sales on the website /www.eventim.hr/, as well as at points of sale at the festival venue.

TICKET RAFFLES

Companies are only permitted to give away Imperial Spirits tickets for advertising purposes if they are in hold of a written approval of LRH. Raffled tickets without permission lose validity and will be deactivated.

LEGAL CONSEQUENCES OF VIOLATIONS

Any violation of these house rules can be punished with a reprimand from the venue. It should be noted that the disregard of the eviction by the police surveillance organs constitutes an administrative offense. Any behavior that is relevant to administrative or criminal law will be reported to the responsible authorities without exception.

FINAL PROVISIONS

Should individual provisions of the house rules be ineffective or impracticable or become ineffective or unenforceable after the conclusion of the contract, the validity of the remaining provisions remains unaffected.
